Tapy Terms of Use

These terms are an agreement between you and Nguyen Tung Son, who runs Tapy as the household business Son Nguyen IT Solutions in Ho Chi Minh City, Vietnam (“we”). They cover the Tapy app and keyboard and the online services behind them: dictation, Fast mode, translation, edits, free minutes and plans. The Privacy Policy (happytapy.app/privacy) says what happens to your data.

By using Tapy’s voice or AI features, you accept these terms. If you don’t accept them, don’t use those features; the keyboard still types without them.

The app and Apple’s license

Apple’s Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) is the license for the app itself. These terms add the rules for Tapy’s services. Where the two differ, Apple’s agreement governs the license to the app, and these terms govern the services.

Who can use the AI features

The services behind Tapy’s AI features are for adults. To use them, you must be 18 or older, and old enough where you live to agree to these terms.

What Tapy does

  • Tapy writes what you say as text, translates, and rewrites text when you ask, using AI services run by other companies: Google’s Gemini models through OpenRouter, and Soniox in Fast mode. Our server passes your requests to them. The Privacy Policy lists what is sent.
  • Each iPhone gets 60 free minutes of speaking, once. We may change the free minutes we give to new users.
  • We work to keep Tapy fast and reliable, but we can’t promise it will always be available or free of errors. The services behind it can change, slow down or stop, and we may change, add or remove features.

AI makes mistakes

Text written by AI can be wrong. It can mishear words, leave words out or add them, mistranslate, or change your meaning. Read the text before you send or use it. Don’t rely on Tapy where a mistake could cause harm, such as emergencies, medical, legal or financial decisions, or safety, unless a person checks the text first.

Your content

What you say and write stays yours. You allow us, and the services behind Tapy, to process it only to give you the feature you asked for, as the Privacy Policy describes. We claim no rights in it.

You are responsible for what you dictate, translate and send. When you record or transcribe other people, get their consent where the law requires it.

Using Tapy fairly

Don’t use Tapy to:

  • break the law or other people’s rights, including their privacy and intellectual property;
  • harass, threaten or deceive people, or to make sexual content involving minors, hateful content, or content that incites violence;
  • record or transcribe people without the consent the law requires;
  • get around the free minutes or a plan’s limits, share or sell your access, or overload our server;
  • copy, take apart or misuse our server or its access codes, or use Tapy to build a competing service or to train AI models.

The services behind Tapy have their own rules, and you agree to follow them when you use Tapy: OpenRouter’s terms (openrouter.ai/terms), the policies of the AI model providers, such as Google’s Generative AI Prohibited Use Policy (policies.google.com/terms/generative-ai/use-policy), and Soniox’s terms (soniox.com/policies/terms-of-service).

If Tapy is used against these terms, we may stop the free minutes or a plan’s access to the AI services.

Plans and payments

  • Plans are monthly subscriptions bought through Apple. Apple charges your Apple Account; we never see your card or payment details.
  • A plan renews each month until you cancel it. Cancel at least 24 hours before the end of the current month to avoid the next charge, in your Apple Account settings: support.apple.com/en-us/118428
  • Each plan gives hours of speaking per month. Hours you don’t use in a month don’t carry over. When a plan’s hours run out, Tapy uses any free minutes you have left.
  • The app shows each plan’s price before you buy, in your currency. Apple adds the taxes that apply where you live. If a price changes, Apple tells you before it takes effect, as its rules require.
  • Apple handles refunds under its own policies. Ask for one at reportaproblem.apple.com.
  • With your own OpenRouter key, OpenRouter charges your account under its terms, and your own key’s requests don’t count against your minutes. Fast mode is the exception: it always goes through our server and counts your free minutes or plan hours.

Changes

We may change these terms. We will post the new version on this page with a new date, and tell you in the app when a change matters. If you keep using the AI features after a change takes effect, the new terms apply.

You can stop using Tapy at any time and delete it. Cancel a plan in your Apple Account settings.

Warranty and liability

Tapy is provided “as is” and “as available”. As far as the law allows, we give no warranties, including that it fits a particular purpose or is free of errors.

As far as the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or business. Our total liability for all claims about Tapy is limited to the greater of what you paid for Tapy in the 12 months before the claim and USD 50.

Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud or for death or personal injury caused by negligence, or takes away the rights you have as a consumer under the law of the country where you live.

Apple

These terms are between you and us, not Apple. Apple is not responsible for Tapy or its content, and has no duty to provide maintenance or support for it. If Tapy fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the price you paid for the app, if any; as far as the law allows, Apple has no other warranty duty for Tapy. Apple is not responsible for claims about Tapy, including product liability claims, claims that it does not meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone’s intellectual property; we are. You confirm that you are not in a country under a U.S. Government embargo or that the U.S. Government has designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Law and disputes

The law of Vietnam governs these terms. Disputes go to the competent courts of Ho Chi Minh City, unless the law of the country where you live lets you, as a consumer, go to a court there. Please write to us first, so we can try to solve the problem.

These terms are written in English and Vietnamese. If the two differ, the English version applies, unless the law where you live requires otherwise.
